Jury Verdict for Client with a Lumbar Disc Herniation

Ralph S. Palmer and Eric M. Palmer have obtained a $81,062 net jury verdict on behalf of their client that suffered a L4-5 paracentral disc herniation in a motor vehicle accident. MRI results indicated no nerve root compression on the L5 nerve root, but intermittent leg radiculopathy was present.

This lawsuit was an action against an individual insured by Farmers Insurance Group. The defendant admitted liability, but disputed the nature and extent of the injuries sustained by the plaintiff. Shortly before trial, Farmers made an offer of settlement in the amount of $20,000.00, which was declined by the plaintiff.

At trial, the Ramsey County District Court jury determined that the plaintiff had suffered a permanent injury and met the 60-day disability threshold. Additionally, the jury awarded the following special damages:

  • Future Pain, Suffering & Disability: $8,000.00
  • Past Medical Expenses: $17,359.00
  • Future Medical Expense: $25,500.00
  • Past Wage Loss: $4,701.66
  • Future Wage Loss: $14,790.00
    TOTAL: $80,350.66

The gross verdict was offset by $17,155.10 in no-fault benefits previously paid by the plaintiff’s auto insurer; however, Plaintiff recovered double-costs under Rule 68 that totaled $17,662.25. The net verdict resulted in an award of $81,062.86.
